I. Overview
The following terms and conditions are to describe the agreement for participation in movement based teacher trainings and workshops, or movement based classes between Katherine LaPlant + Shirah Perry (hereafter referred to by name, or as the ‘regarding form GbR | Katherine LaPlant + Shirah Perry) and any participant (hereafter referred to as a “participant” or the “Client”)
II. Registration / Conditions of Participation / Credit Usage
Participation in a training or workshop requires a binding registration. All registrations require submission of a non-refundable deposit within 8 days of the relevant invoice’s receipt.
It is the responsibility of the participant to understand the course requirements that may be unique to each individual course and to complete these requirements within the prescribed timeframe in order to receive their certificate. Participants who do not meet the requirements for course completion are eligible to receive a certificate of course audit.
Payment: a non-refundable deposit is due upon registration. Tuition remainder is due two weeks before the start of the program. Payment is available by bank transfer only.
Cancellation:
Tuition costs (excluding the non-refundable deposit) are refundable until 14 days prior to the training’s start.
Teacher training participants who initiate course cancellation less than 14 days prior to the training’s start will forfeit the non-refundable deposit, plus 50% of the remaining tuition costs. The remaining amount is refundable.
AMA-only participants will not be eligible for a refund less than 14 days before the AMA begins. However, tuition can be applied to any future AMA within one calendar year.
All refunds will incur a €100 (+ MwSt) service fee. Alternatively, all tuition payments can be applied toward a future training within one calendar year..
‘regarding form GbR | Katherine LaPlant + Shirah Perry’ reserves the right to cancel or postpone any training that does not garner the requisite minimum number of participants. ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ also reserves the right to shift any portion of a training scheduled to be held in person to a virtual format. Additionally, ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ reserves the right to cancel or postpone any training in case of uncontrollable circumstances related to pandemic, natural disaster, or any other “force majeure.” In this event, tuition fees remain subject to the terms above, or are transferable to any future training within one calendar year.
Audit: Participants who have previously taken the BEbarre teacher training may take the AMA workshop as a refresher for €100 (+ MwSt).
Practice hours: All self practice and practice teaching hours (supervised and unsupervised) must be completed prior to the final test out.
Retest Policy: Completion of the course requires a passing grade of at least 80% on both a written exam and a practical exam (mock class). If a participant’s score on either exam is between 70-80%, the participant will receive feedback and may choose to reschedule their exam.
However, if a participant receives a score between 60-70% on either exam, they can choose from the following options:
1. Schedule a minimum of one hour of private tutoring, followed by a retest of the relevant exam(s) for €200 (+ MwSt)
2. Receive a certificate of course audit which will acknowledge their participation in the AMA and ITM but not certify completion of the course
Participants who receive a score of less than 60% on their practical exam can choose from the following options:
1. Schedule a minimum of 1 hour private tutoring, followed by 5 additional Supervised Teaching Hours (this may take place during a subsequent round of training), followed by an additional retest for €300 (+MwSt)
2. Retake a subsequent AMA + ITM (space permitting), attend unlimited additional Supervised Teaching Hours (but a minimum of 5), and schedule an additional retest for €650 (+ MwSt)
3. Receive a certificate of course audit which will acknowledge their participation in the AMA and ITM but not certify completion of the course
III. Terms of payment
All payments collected by ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ are subject to the requisite 19% MwSt.
Payments can be made by bank transfer only.
IV. Assumption of risk / Release of Liability
By participating in a training or workshop, the client acknowledges that participation in any form of exercise (whether in-studio, at home, or virtually) with ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ may involve risks, including risk of personal injury. By booking a training or workshop, the client furthermore acknowledges that to engage in any exercise, or use any equipment for any purpose, is to be done at their own risk and that they assume the risk of any and all injury and/or damage that may be suffered, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any equipment, whether provided by ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ or otherwise.
By booking a training or workshop, the Client acknowledges that a teacher training representing ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ may use tactile cueing and adjustment methods, or make physical contact with the Client for correction purposes in order to ensure that the session is undertaken in accordance with the ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ protocols and best intentions. By booking a training or workshop, the Client agrees that they are voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to themself or their property.
Any teacher trainer representing ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ is not medically trained and is therefore not qualified to assess whether the Client is in good physical condition and/or that the Client is able to engage in exercise without detriment to their health, safety, comfort and/or physical condition. Participants are advised to seek medical advice prior to commencing any exercise program or movement education program if they are in any doubt about their ability to engage in such activities as they may involve risks, including risk of personal injury.
V. Data protection
Information collected by the ‘regarding form GbR | Katherine LaPlant + Shirah Perry’ is confidential and will not be passed on to any other parties without consent from the Client.

VI. Governing Law
The aforementioned terms and conditions are to be interpreted and applied as under law in the Federal Republic of Germany.
